POWELL, Judge.

Lawrence C. "Dick" Doyle was charged by information filed in the district court of Tulsa County with the offense of unlawful possession of intoxicating liquor, second and subsequent offense, a felony. A jury was waived and defendant was tried before the court, found guilty and punishment fixed at one year in the State Penitentiary at McAlester, and a fine of $500.
