The action involved on this appeal is to recover for alleged personal injuries and property damages arising from a fire which occurred April 9, 1955, at 546-548 Rice Street in the city of St. Paul. It appears from the record that two actions based upon the same claim had previously been commenced and dismissed. The first action was brought by Mr. and Mrs. Virgil J. Falkenstein, et al., against Mr. and Mrs. Leon Braufman and was dismissed without prejudice...
