Defendant's appeal comes to us upon a clerk's transcript. Defendant was indicted for the crime of breaking and entering as defined in section 708.8, Code 1954, I.C.A. He pleaded not guilty, then guilty and, finally, not guilty again. He was tried before court and jury, found guilty and sentenced to a term of not more than ten years in the men's reformatory.
