This case is before us on a Clerk's transcript. Defendant was indicted, tried and convicted of violation of State Liquor Control Act, in violation of Section 123.3, 1954 Code of Iowa, I.C.A. He was fined in the amount of $500, and in default of the payment of said fine that he be imprisoned in the Polk County jail at hard labor one day for each $5 of said fine not paid, but not exceeding a total of one hundred days, as provided in Section 123.91, 1954...
