Appeal from that part of an order denying a new trial, which order was made pursuant to defendant's blended motion for amended findings and conclusions of law, or in the alternative for a new trial.

We are here concerned with the proper law applicable in an action brought by the plaintiff, as the owner of a city lot, against the defendant, as the owner of an adjoining lot, to recover damages caused by the flooding of plaintiff's basement....
