On July 21, 1956, plaintiff, then two years and three months old, suffered injuries when he fell off the basement stairs of a house which defendant had constructed and sold to plaintiff's parents. Plaintiff based his case on the absence of an extra rail extending between the handrail and the basement stairs. The jury returned a verdict for $40,000 and judgment was entered on the verdict.
