This is an appeal from an order of the trial court denying defendant's motion for judgment notwithstanding the verdict or a new trial.

Defendant is the owner of some apartment buildings in Minneapolis. For a number of years prior to February 1954 plaintiff had been employed as a caretaker of one of defendant's apartment buildings located at 74 Spruce Place in Minneapolis.
