The second count of the indictment, upon which the case was submitted to the jury, alleged that appellant "was an officer, agent, servant and employee of Physicians Life and Accident Insurance Company of America" and that he embezzled, misapplied and converted to his own use $225,000 belonging to said company, which was under his care
