We will refer to defendant in error as "plaintiff" or "Ratliff", to the City of Pueblo as "Pueblo" or "City" and to MacIndoe Plumbing & Heating, Inc., a corporation, as "MacIndoe". John M. MacIndoe, dba John M. MacIndoe Plumbing & Heating, was dismissed as a party by the trial court and no error is assigned thereto.
