Plaintiff in this case is a builder and defendant the carpenter subcontractor whom he hired to do the carpentry work upon a particular house.

It appears that after many vicissitudes the house was completed to the general specifications of the buyer; but on delivery it was ascertained that the first floor was not level and that the windows did not fit properly.
