This cause was tried before the Court, sitting at Montgomery, Alabama, on October 29, 1957, without a jury. Said cause was submitted upon the issues as made up by the pleadings and the proof, the latter consisting of the oral testimony of several witnesses, stipulations between the parties, and several exhibits.
