The plaintiff contends that lot 8 is the southerly part of a peninsula connected with lot 1 by the causeway. The defendant contends that lot 8 is located upon an island.

Photostatic records of government surveys recorded in the office of the register of deeds of Burnett county indicate that the original government survey was made in 1856. The lake was shown thereon but the survey and field notes did not show any islands in the lake, although...
