However, it is stated somewhat differently by counsel. In the appellant's brief it is said:

"The question presented for decision is: When a permittee (as found by the jury) of a named insured is involved in an accident with the named insured's automobile, vanishes to points unknown without apprising the named insured or the named insured's insurance carrier of the accident...
