The plaintiff's appeal from the order of the board of inspectors denying permission to erect a billboard sought a variance under RSA 31:72 III, and alleged that the ordinance is invalid and unconstitutional, in that the provisions forbidding billboards constitute an abuse of the police power and a taking of the plaintiff's property without compensation.
