The plaintiff in error, Guy Phillips, hereinafter referred to as defendant, was charged in the district court of Pittsburg County, jointly with one Delbert Blevins, with the larceny of a saddle, valued at $50. A jury was waived by the parties and they were tried by the court and found guilty.
