WARD, Justice.

The question is: Was appellant's employee, a truck driver, acting within the scope of his employment when he injured appellee? Over appellant's objections, the question was submitted to a jury which gave appellee $1,250 actual damages and $500 exemplary damages.

We agree with appellant that the record contains no substantial evidence to support the above verdict and the judgment of the Court.
