Libellant is the owner of the Tug Capt. H. V. Dufrene. He alleges that his tug was damaged by excessive wave wash created by the M/V Diversity as that vessel was navigating the Harvey Canal1 on the early morning of April 14, 1956. At the time the Capt. Dufrene was moored outboard an LSM which in turn was moored to the McDermott dock on the canal.
