BIRD, Judge.

In 1926, the appellant, Clyde Green, was convicted of manslaughter in the Warren Circuit Court and sentenced to twenty-one years in the penitentiary, a portion of which he served before commutation parole, restoration and pardon.

In 1954, he was again convicted of manslaughter in the Hardin Circuit Court and sentenced to forty-two years in the penitentiary, the augmented penalty being provided by KRS 431.190 for his second manslaughter conviction...
