The appellant, Marlin Bacon, who will hereafter be referred to as the defendant, was forty years of age at the time of the hearing in the trial court in which the court's judgment was filed on November 29, 1957. The child whose custody is involved, known as Allen Eugene Bacon, was six. About the year 1942 the defendant was living in Waynesboro, Pennsylvania.
