Defendant's appeal comes to us upon a clerk's transcript. Defendant was indicted for the crime of manslaughter, pleaded not guilty, tried before court and jury, found guilty and, pursuant to section 690.10, Code 1958, I.C.A., sentenced to the penitentiary for a term not exceeding eight years and fined one dollar. We find no error and the judgment is
