The appellant, Frank Kancso, appeals from a judgment of conviction and sentence of five years imprisonment for possession of narcotics in violation of 21 U.S.C.A. §§ 173 and 174, after a trial before the court without a jury. Prior to the trial appellant had moved for an order pursuant to Rule 41(a) of the Federal Rules of Criminal Procedure, 18 U.S.C.A., to suppress as evidence seven ounces and one hundred grains of heroin on his person...
