In this action plaintiff seeks to recover compensatory damages for personal injuries and mental pain and suffering and punitive damages as the result of an assault and battery alleged to have been committed upon him by defendant. The jury returned a verdict for plaintiff in the sum of $5,000 compensatory damages and $2,500 punitive damages. Defendant appeals from an order denying his alternative motion for judgment notwithstanding the verdict...
