This is a criminal action prosecuted in the name of the State of Nebraska, wherein Wesley Harms Peery was prosecuted for the crime of breaking and entering a residence with intent to steal property of value. He was convicted of the charge by a jury and was duly sentenced to serve a term of 5 years in the State Penitentiary. He filed a motion for new trial which was overruled.
