On a prior appeal to this court from an order of the district court dismissing a petition for writ of habeas corpus without a hearing, this cause was remanded for a hearing. After the parties were heard, the district court again dismissed the petition and denied the issuance of a certificate of probable cause. Subsequently, on August 5, 1957, on appellant's petition, a certificate of probable cause was entered by our order and leave was granted...
