HIGGINS, Justice.

The appellant asks for a reversal of the judgment or a new trial on the basis of 12 assignments of error. We quote assignment No. 1: "The court erred in permitting the plaintiff to testify as shown by Exceptions Nos. 1 (R. p. 11), 2 (R. p. 12) and 3 (R. p. 12)."
