This is an action on a note signed by the defendants as makers payable to the Globe Remodeling Company and endorsed by it to the plaintiff before maturity. The defendants filed an affidavit of defense under county court rule 9 setting up fraud in procuring the note, and signatures thereto, by the Globe Remodeling Company; that plaintiff is not a holder in due course; and, that representations made by the Globe company were a part of a general scheme...
