This is an appeal from a summary judgment in favor of plaintiff and denying cross motion of defendant for summary judgment. The appellant was defendant below in an action to recover a broker's commission.

The negotiations which formed the basis for the action were all contained in letters of correspondence between the parties. Plaintiff alleged that defendant had agreed to pay a commission on the purchase of a newspaper business...
