George and Eleanor Vasquez (respondents) owned approximately 58 acres of agricultural land in La Puente. In July 1954, they orally employed Roxy Prather, a licensed real estate broker, to obtain a purchaser. Mrs. Prather obtained Frank R. Halterman, and the parties signed escrow instructions on July 15, 1954.

The escrow instructions contemplated a sale of the property to Halterman or his nominee...
