On the death of James H. Hummel, corporal in the United States Army, his widow, Vernelle Nichols Hummel Hall, claimed the sum of $10,000.00 under the Servicemen's Indemnity Act of 1951, 38 U.S.C.A., § 851 et seq. The Veterans' Administration denied her claim, and she brought suit against the United States in the District Court for the Western District of South Carolina, alleging that she had "exhausted every remedy short of resorting to the Courts...
