Throughout this opinion the plaintiff and respondent will be referred to as "Consumers", and the defendant and appellant will be referred to as "Durante".

This case is before the court upon an appeal by Durante, from the judgment of the court in favor of Consumers and against Durante, in the sum of $5,848 with interest thereon at 7% per annum...
