The defendant in this suit obtained a default judgment in the District Court against the plaintiff herein and pursuant to said judgment had issued a writ of fieri facias which directed the sale of certain merchandise upon which was claimed a vendor's lien and privilege in order to satisfy the money judgment obtained. While the advertisement for the sale of these articles was being made the present plaintiff instituted this suit. The defendant filed exceptions...
