Dominic Gigliotti instituted this action against the New York, Chicago & St. Louis Railroad Company (Nickel Plate Railroad) in the Municipal Court of the city of Lorain for injuries and damages received as the result of a collision between an automobile which he was driving and an engine of the railroad company, at a point where the railroad tracks crossed, at right angles, the public thoroughfare upon which he was driving.
