This is a summary of plaintiff's evidence: On the night of 5 November 1956 State Highway Patrolmen P. M. Herring, Jr. and H. W. Pridgeon went to the scene of an automobile wreck on Highway No. 70 some seven miles east of the City of New Bern. They and an ambulance arrived at the same time.
