This is an appeal from an order granting a new trial, after a verdict in favor of the defendants in a suit for damages growing out of an automobile collision which took place at an uncontrolled street intersection in the city of Spokane. The defendants' cross-complaint and affirmative defense of contributory negligence were removed from the consideration of the jury before the case was submitted.
