The appellant was indicted and tried on a charge of murder in the first degree and was found guilty of murder in the second degree for which he was sentenced by the court below to twenty years.

The homicide occurred on October 2, 1950, following which the defendant was indicted on October 24, 1950, and was arraigned on November 10, 1950, at which time the pleas of not guilty and not guilty by reason...
