The plaintiff, Barbara Mickelson, is the surviving widow of Orville Mickelson, deceased, who died October 14, 1952. He had been employed by the Seven Up Bottling Company of Bismarck, from April 1948 to October 7, 1952. His employer the Seven Up Bottling Company was insured under the North Dakota Workmen's Compensation Act, NDRC 1943, 65-0101 et seq.
