MESSMORE, Justice.

Plaintiff in error, Daniel Ysac, hereinafter called the defendant, was charged in an information in the district court for Scotts Bluff County with the crime of rape under section 28-408, R.R.S.1943. He was 19 years old at the time of the alleged offense. The prosecutrix was 15 years old at that time. The defendant entered a plea of not guilty and upon trial to a jury was found guilty as charged.
