This is an appeal from a summary conviction on a charge of violating a provision of The Vehicle Code of May 1, 1929, P. L. 905. Appellant contends that the justice of the peace was not the nearest available magistrate within the borough where the alleged violation occurred and that the proceedings were fatally defective for want of jurisdiction of the justice of the peace.
