FAHY, Circuit Judge.

On December 29, 1938, appellant brought about the death by poison of a young woman whom he believed to be of ill-repute. He said that he intended to kill all prostitutes in town if he could. He was promptly arrested and on February 1, 1939, was indicted for first degree murder.
