This cause arises out of the same facts and circumstances as those set out in our cause No. A-6268, styled Alamo Express, Inc. v. Union City Transfer, 309 S.W.2d 815, with the differences herein noted.

Petitioners, except the Railroad Commission, were not parties to the proceedings had by the Railroad Commission which resulted in the granting of the amended certificates...
