Upon a trial before the Court without a jury appellant was convicted of unlawfully possessing policy paraphernalia and his punishment assessed at confinement in jail for 60 days.

The State's evidence shows that on the day in question Officers L. W. Cook and Edwin D. Coombs went to the residence of William Wesley Varnell at 1216½ Summer Street in the City of Houston for the purpose of executing a search warrant for policy paraphernalia...
