This action (contract or tort) was originally brought against the defendant Jacobson (hereinafter called Jacobson) and Roux Laboratories, Inc. (hereinafter called Roux), to recover damages for a severe skin infection alleged to have been caused to the plaintiff by the use of hair dye made by Roux, which the plaintiff purchased from Jacobson in April, 1949.
