Joe Moore and Wallace Moore instituted this action against Joe Meyer, doing business as Tulsa County Airport, and Frank Sellmeyer to recover damages for injuries to an airplane owned by plaintiffs. A demurrer by the defendant, Sellmeyer, to plaintiffs' evidence was sustained and no appeal was taken from the ruling.
