This action is founded upon a claimed contract of employment by virtue of which the plaintiff claims he was promised, but refused, "light work." At the conclusion of the plaintiff's testimony, the District Court dismissed the action pursuant to Rule 41 of the Rules of Civil Procedure, 28 U.S.C.A., upon the ground that the plaintiff had shown no right to relief.
