Judgment unanimously affirmed.

On February 21, 1955 appellant was indicted for the crime of which he was convicted. At that time he was in custody in Suffolk County, awaiting disposition of criminal charges there pending against him. On May 25, 1955 the Nassau County authorities were informed that appellant had been received in Sing Sing Prison, pursuant to a judgment of the County Court, Suffolk County, convicting him of robbery in the third degree.
