The appeal from the judgment was taken after the statutory time to appeal expired.

An appeal from the order on the motion for reargument does not lie, as of right, but only by permission, and no permission to appeal was granted (see N. Y. City Mun. Ct. Code, § 154; Collins v. Woods, 77 N.Y.S.2d 803).

The appeal should be dismissed, with $10 costs.
