The defendant-appellant, Arnold James Erickson, was accused by an indictment of the Grand Jury of Polk County, Iowa, of the crime of operating a motor vehicle while intoxicated, on the public highways of said County on or about May 12, 1956, as defined in Section 321.281 of the 1954 Code of Iowa, I.C.A.—third offense—in that the accused had two times previously been convicted...
