Plaintiff, as the insurer against damages arising as the result of a collision or upset of a Buick automobile of one R. F. Bernard, brought this action as subrogee of the insured for reimbursement of the damages paid as the result of a collision between said automobile and a pick-up truck of the defendant, Moodie Wallace, operated and driven by him at the time of the collision.
