Plaintiff in Error, Theodore Rhamy, hereinafter referred to as defendant, was charged by indictment filed in the district court of Payne County with the crime of rape in the first degree, was tried before a jury, convicted and his punishment fixed at fifteen years, in the state penitentiary.
