Dougherty and Childs, hereinafter called defendants, were arrested in Brunswick County on warrants charging them with unlawful picketing in violation of § 40-64, paragraph 3, Code of Virginia, 1950, as amended by Acts of Assembly 1952, chapter 674, pages 1123, 1124. Upon conviction in the Trial Justice Court the defendants appealed to the Circuit Court where the cases were submitted to the court upon an agreed stipulation of facts. Dougherty...
